Privacy Policy

This Privacy Policy describes how Rachel Scheer Nutrition, LLC ("Rachel Scheer Nutrition," "we," "us," or "our") collects, uses, and shares your personal information when you visit, purchase from, or otherwise interact with www.functionalnutritioncertification.com  (the "Site") and the products, programs, and services we offer, including functional wellness coaching, functional medicine lab testing, dietary supplements, online courses, memberships, masterclasses, and the RSN Institute Functional Nutrition Certification (collectively, the "Services").


This Privacy Policy applies to information we collect through the Site and Services. It does not apply to information we collect offline outside the Services, or to information collected by any third party, including through any application or content (including advertising) that may link to or be accessible from the Site.

1. PERSONAL INFORMATION WE COLLECT

We collect several categories of personal information about you depending on how you interact with us.


1.1. Information you provide to us directly.


Account Information. When you create an account on the Site, the client portal, the supplement store, a course platform, or the RSN Institute Certification platform, we collect your name, email address, password, and any optional profile information you provide.


Order Information. When you make or attempt to make a purchase through the Site or Services, we collect your name, billing address, shipping address, payment information (including credit card numbers, processed by our payment processor), email address, and phone number.


Health and Wellness Information. If you become a coaching client or purchase functional medicine lab testing, we collect health-related information you provide as part of intake, including health history, current symptoms, medications, supplements, lifestyle information, dietary information, and lab results. This category is treated with additional care; see Section 7 for details.


Program and Course Information. When you participate in courses, memberships, the RSN Institute Certification, or other educational programs, we collect information about your enrollment, progress, submissions, assessments, and participation in live sessions or community forums.


Communications. When you contact us by email, through a contact form, through the client portal, through social media (including direct messages and replies to automated prompts), or by SMS, we collect the content of your communications and any contact information you provide.


Marketing Information. When you sign up for our email list, opt in to SMS messages, register for a free resource or masterclass, or otherwise engage with our marketing, we collect the information you provide, including name, email address, and phone number.


Practitioner Information. If you apply to or enroll in the RSN Institute Functional Nutrition Certification, we collect professional information including credentials, license numbers (if applicable), practice information, and business details.


1.2. Information we collect automatically.


When you visit the Site, we automatically collect certain information about your device and your interaction with the Site. We refer to this as "Device Information." This includes:


Information about your web browser, operating system, IP address, time zone, and certain cookies installed on your device.

Information about the pages or products you view, the websites or search terms that referred you to the Site, and the way you interact with the Site.

Information about your engagement with our emails and SMS messages (such as opens, clicks, and conversions).


We collect Device Information using the following technologies:

Log files. Files that track actions occurring on the Site, collecting IP address, browser type, Internet service provider, referring and exit pages, and date/time stamps.

Session replay and analytics tools. Tools that record interactions with the Site for analytics, debugging, and optimization purposes.


When we use the term "Personal Information" in this Policy, we are referring to all of the categories described above.

2. HOW WE USE YOUR PERSONAL INFORMATION

We use the Personal Information we collect to:


Fulfill orders and deliver Services, including processing payments, arranging shipping for supplements and lab kits, providing invoices and order confirmations, granting access to digital products, scheduling coaching sessions, and providing certification program materials.


Provide coaching and lab interpretation Services, which requires the collection, review, and discussion of your health information by your coach.


Communicate with you, including responding to inquiries, sending transactional messages (such as order confirmations, shipping updates, and session reminders), and providing customer support.


Send marketing and promotional messages, including email newsletters, SMS messages, and targeted advertising, where you have consented or where otherwise permitted by law.


Screen orders for potential risk and fraud, including using your IP address and other Device Information.


Operate, maintain, and improve the Site and Services, including generating analytics about how users browse and interact with the Site, measuring the effectiveness of our marketing campaigns, and developing new features.


Personalize your experience, including recommending products, content, and Services that may interest you.


Comply with legal obligations and protect our rights, including responding to subpoenas, search warrants, and other lawful requests, and protecting against fraud, security threats, and other harms.

3. LEGAL BASES FOR PROCESSING (EU/UK USERS)

If you are located in the European Union, United Kingdom, or another jurisdiction that requires a legal basis for processing Personal Information, we process your Personal Information under the following legal bases:


Performance of a contract, when we process Personal Information to provide you with a Service you have purchased.

Legitimate interests, when we process Personal Information for purposes such as fraud prevention, security, analytics, and direct marketing (where permitted).

Consent, when we rely on your consent to send marketing communications, including SMS messages, or to use certain cookies.

Legal obligation, when we process Personal Information to comply with applicable law.

4. HOW WE SHARE YOUR PERSONAL INFORMATION

4.1. Service providers. We share Personal Information with third-party service providers who help us operate our business, including:

Email and SMS marketing platforms (such as our email service provider and SMS messaging platform), used to send the marketing and transactional communications you receive from us.

Customer relationship and funnel management platforms, used to manage leads, contacts, communications, and customer journeys.

Coaching and client portal platforms, used to schedule sessions, deliver coaching content, store intake forms, and communicate with clients.

Course and certification platforms, used to deliver online education and certification programs.

Lab testing partners and their fulfillment providers, used to provide and process functional medicine lab testing.

Shipping and fulfillment providers, used to ship supplements and lab kits.

Advertising platforms (such as Meta/Facebook, Instagram, Google Ads, TikTok, and others), used to deliver targeted advertising and measure ad performance.

Professional service providers, including legal, accounting, and other advisors who require access to Personal Information to perform their services for us.


4.2. Legal compliance and protection. We may share Personal Information when we believe in good faith that disclosure is necessary to comply with applicable laws and regulations; to respond to subpoenas, search warrants, or other lawful requests for information; to enforce our Terms of Service; or to protect the rights, property, or safety of Rachel Scheer Nutrition, our customers, or others.


4.3. Business transfers. If Rachel Scheer Nutrition is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of business assets, Personal Information may be transferred as part of that transaction. We will notify you of any such change in ownership or control of your Personal Information through a notice on the Site or by email.


4.4. With your consent. We may share Personal Information with other third parties when you have given us your consent to do so.

5. COOKIES AND TRACKING TECHNOLOGIES

We and our third-party service providers use cookies and similar tracking technologies on the Site to collect information about your browsing activities. The types of cookies we use include:

7. HEALTH INFORMATION

7.1. As part of our coaching and lab testing Services, we collect health-related information from you. This includes information you provide during intake, in coaching sessions, through symptom assessments, and in connection with functional medicine lab testing.


7.2. Rachel Scheer Nutrition is not a medical practice and, for most Services, is not a "covered entity" under the federal Health Insurance Portability and Accountability Act (HIPAA). However, we treat health information you share with us as confidential and use reasonable administrative, technical, and physical safeguards to protect it.


7.3. Health information may be shared with the following third parties as necessary to provide Services:


Your assigned coach and other Rachel Scheer Nutrition team members who need access to provide your Services.

Lab testing partners that perform the tests you have purchased.

Licensed providers who provide medical oversight or authorization where required by law for certain lab tests.

Coaching and client portal platforms that store your intake and session information.


7.4. We do not sell health information. We do not use health information for behavioral advertising.


7.5. Certain U.S. states (including Washington and Nevada) have enacted laws granting residents additional rights with respect to consumer health data. If you are a resident of one of those states, additional rights may apply; contact us using the information in Section 17 to exercise those rights.

8. SMS / TEXT MESSAGES

8.1. If you opt in to receive SMS messages from Rachel Scheer Nutrition — including through a keyword reply, a web form, a checkout opt-in, or any other consent mechanism — you may receive recurring marketing, promotional, transactional, and informational text messages from us.


8.2. You may opt out of marketing SMS messages at any time by replying STOP to any message we send. You may request help by replying HELP.


8.3. Message frequency varies. Message and data rates may apply, depending on your mobile carrier plan.


8.4. Phone numbers and SMS opt-in records are stored by our SMS service provider and used to send messages, manage opt-ins and opt-outs, and maintain compliance records. We do not share phone numbers collected for SMS purposes with third parties for their own marketing.


8.5. Additional terms governing SMS messages are described in our Terms of Service.

9. YOUR RIGHTS AND CHOICES

Depending on where you live, you may have certain rights with respect to your Personal Information.


9.1. All users. Regardless of your location, you may:


Unsubscribe from marketing emails at any time by clicking the "unsubscribe" link in any marketing email or by contacting us.

Opt out of marketing SMS messages by replying STOP.

Disable cookies through your browser settings.

Opt out of targeted advertising using the links in Section 6.


9.2. California residents (CCPA/CPRA). If you are a California resident, you have the right to:


Know what categories of Personal Information we collect, the sources from which we collect it, the purposes for which we collect it, and the categories of third parties with whom we share it.

Request access to the specific pieces of Personal Information we have collected about you.

Request that we correct inaccurate Personal Information.

Request that we delete Personal Information we have collected from you, subject to certain exceptions.

Opt out of the "sale" or "sharing" of your Personal Information. While we do not sell Personal Information in the traditional sense, our use of certain advertising technologies (such as cookies that enable cross-context behavioral advertising) may be considered "sharing" or "selling" under California law. Limit the use of sensitive Personal Information.

To exercise your California privacy rights, contact us using the information in Section 17. We will verify your identity before responding to your request. You may also designate an authorized agent to make a request on your behalf.


9.3. California Shine the Light. California Civil Code Section 1798.83 permits California residents to request certain information regarding our disclosure of Personal Information to third parties for direct marketing purposes. To make such a request, contact us using the information in Section 17.


9.4. Residents of other U.S. states. If you are a resident of Virginia, Colorado, Connecticut, Utah, or another U.S. state with a comprehensive privacy law, you may have rights similar to those described above for California residents, including the right to access, correct, delete, and opt out of certain uses of your Personal Information. Contact us using the information in Section 17 to exercise these rights.


9.5. European, UK, and Swiss residents. If you are a resident of the European Economic Area, the United Kingdom, or Switzerland, you have the right to:


Access the Personal Information we hold about you.

Request correction, update, or deletion of your Personal Information.

Restrict or object to certain processing.

Request data portability.

Withdraw consent for processing based on consent (without affecting the lawfulness of processing before the withdrawal).

Lodge a complaint with a supervisory authority.


We process your Personal Information to fulfill contracts we have with you (for example, to deliver Services you have ordered), to pursue our legitimate business interests, to comply with legal obligations, or with your consent. Your Personal Information may be transferred outside of Europe, including to the United States.

10. CHILDREN'S PRIVACY

The Site and Services are not directed to children under the age of 13, and we do not knowingly collect Personal Information from children under 13. If you believe we have collected Personal Information from a child under 13, please contact us using the information in Section 17 and we will take steps to delete the information.


Account registration and purchases on the Site require users to be at least 18 years of age. See our Terms of Service for additional eligibility requirements.

11. GLOBAL PRIVACY CONTROL

Some browsers and browser extensions support a Global Privacy Control (GPC) signal, which communicates a user's preference to opt out of the sale or sharing of Personal Information for cross-context behavioral advertising. Where required by law, we honor GPC signals as opt-out requests.

12. DATA RETENTION

We retain Personal Information for as long as needed to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. Specific retention periods vary based on the category of information:


Order Information is retained for our records unless and until you request deletion, subject to recordkeeping obligations under tax and consumer protection law.

Account Information is retained for as long as your account is active and for a reasonable period afterward.

Health Information collected as part of coaching and lab testing is retained in accordance with applicable professional and recordkeeping requirements.

Marketing Information is retained until you unsubscribe or opt out, plus a reasonable additional period for compliance purposes.

13. SECURITY

We use reasonable administrative, technical, and physical safeguards to protect Personal Information from unauthorized access, disclosure, alteration, and destruction. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.

14. INTERNATIONAL DATA TRANSFERS

Rachel Scheer Nutrition is based in the United States. If you access the Site or use the Services from outside the United States, your Personal Information will be transferred to, stored, and processed in the United States and other countries where our service providers operate. By using the Services, you consent to the transfer of your Personal Information to the United States and other jurisdictions, which may have data protection laws different from those in your country of residence.

15. THIRD-PARTY LINKS

The Site may contain links to third-party websites and services that are not operated by us. This Privacy Policy does not apply to those third-party sites and services. We encourage you to review the privacy policies of any third party before providing them with your Personal Information.

16. CHANGES TO THIS POLICY

We may update this Privacy Policy from time to time to reflect changes to our practices or for other operational, legal, or regulatory reasons. The "Last Updated" date at the top of this Policy reflects the date of the most recent revision. We encourage you to review this Policy periodically.
